Hein Poulus, KC and Kelly Ann Maw obtained an order to vary a Mareva injunction to permit certain business expenditures.

In this case, an ex parte Mareva injunction was granted at the outset of the litigation against multiple defendants which prevented them from in any way disposing of dealing with or diminishing the value of their assets. The defendants included trustees of trust’s assets that included real properties and a real estate portfolio with ongoing expenses.

The application involved consideration of the parameter of the standard exception term found in Mareva orders which permit “ordinary and proper business expenses”.
