In Century 21 Canada Limited Partnership v. Real Estate Webmasters Inc., 2024 BCSC 518, Laésha J. Smith, Kyle Thompson and Kelly Ann Maw, over the course of a 4-day hearing, successfully defended against Century 21’s application to strike REW’s response to civil claim and counterclaim for failure to comply with the Rules and a court order.  The team also successfully defended against the alternative relief sought by the Century 21 for an order to inspect REW’s systems, an affidavit verifying REW’s list of documents and leave to examine a second REW representative. In addition to defending against Century 21’s application, the team also successfully obtained an order against Century 21 for the production of documents.
