Kyle Thompson, together with his co-counsel Sadaf Kashfi of Edelmann & Co., was recently successful on an application before the Human Rights Tribunal to add respondents to the claim after the expiration of the 1-year limitation period: Buchanan v. Providence Health Care and others, 2023 BCHRT 50. Counsel are acting pro bono on behalf of a claimant alleging discrimination during, among other things, an involuntary certification under the Mental Health Act. The Tribunal accepted the claimant’s arguments that the proposed physician respondents should be added because adding them to the complaint would serve the public interest, their conduct was at the core of the alleged discrimination, and there was no substantial prejudice.
